Privacy Notice

External statement informing individuals how an organization collects, uses, shares, and protects their personal information.

Definition

Privacy notices must be clear, concise, and accessible, and laws prescribe content: GDPR Articles 13 and 14 require identity of controller, purposes, lawful bases, recipients, transfers, retention, and rights; CCPA requires categories, purposes, sale or sharing disclosures, and rights. A privacy policy, by contrast, is often the internal governing document.

Example

A layered privacy notice gives a short summary with links to detailed sections.

Exam tip

Notice is external; policy is internal. Misrepresenting practices in a notice can be an FTC deceptive practice.
