Safe Harbor

A commitment in a disclosure policy not to pursue legal action against researchers acting in good faith within the stated rules.

Definition

Safe harbor clauses state that the organization considers authorized, good-faith research compliant with anti-hacking laws and will not sue or refer researchers for prosecution. Researchers must stay within scope and avoid privacy violations or service disruption. It encourages reporting rather than silence or public dumping.

Example

A VDP states that research conducted under the policy is authorized under the CFAA.

Exam tip

Safe harbor applies only when the researcher follows the policy's scope and rules.
