HIPAA Privacy Rule

HIPAA rule setting standards for use and disclosure of PHI and individuals' rights over their health information.

Definition

The Privacy Rule permits use and disclosure for treatment, payment, and health care operations without authorization, requires authorization for most other uses such as marketing, and establishes the minimum necessary standard. Individuals have rights to access, amend, receive an accounting of disclosures, and request restrictions. Covered entities must provide a Notice of Privacy Practices and appoint a privacy official.

Example

A hospital may share records with a referring physician for treatment without patient authorization.

Exam tip

Treatment, payment, and operations (TPO) disclosures do not require authorization.
