Data Protection Impact Assessment (DPIA)

GDPR Article 35 assessment required before processing likely to result in high risk to individuals' rights and freedoms.

Definition

A DPIA describes the processing and purposes, assesses necessity and proportionality, assesses risks to individuals, and identifies mitigating measures. It is required for systematic and extensive profiling with significant effects, large-scale processing of special category data, and large-scale systematic monitoring of public areas, among others listed by authorities. If high residual risk remains, the controller must consult the supervisory authority under Article 36.

Example

A city deploying smart cameras in public squares completes a DPIA before launch.

Exam tip

Prior consultation with the authority is required only when high residual risk cannot be mitigated.
